Operating Model — Submission Court (Motion-Day Notation)

NJ-D is a submission court that uses motion days. Counsel files the motion noting the motion day on the cover page; opposition and reply follow per Civ. R. 7.1. The court rules on the papers in its own time. Oral argument is permitted only by the judge's express permission (Civ. R. 78.1).

NJ-D uses the formal motion track for most matters; discovery applications may be presented by telephone conference call or letter to the judge under Civ. R. 37.1, an alternative to formal motion practice that NJ-D codifies district-wide. Among our 10-court sample, NJ-D is the only district with a codified telephone-or-letter alternative for discovery disputes.
