Why it matters

Everlaw, an AI litigation and investigations platform, released survey results on October 20, 2026, developed with Wakefield Research. The study of 300 in-house legal professionals found that 86% now use generative AI for legal work, 54% have already reduced the volume of work they send to outside counsel, and 92% report AI-related cost savings from their law firms. Among respondents whose firms use GenAI, 13% call the savings significant and 56% call them moderate. Eighty-one percent expect outcome-based pricing to overtake the billable hour within five years.

The results build on a 2025 survey released by the Association of Corporate Counsel (ACC) and Everlaw, in which nearly 60% of in-house counsel saw "no noticeable savings yet" from outside counsel's use of generative AI. Other surveys cited in coverage are far less favorable to firms: one found just 7% of clients had noticed a reduction in total matter cost. The 2026 figures are vendor-sponsored, and Everlaw sells litigation AI tools, so its savings numbers warrant skepticism. The report also shows that only 4% of respondents say their outside firms are not using GenAI, down from 59% who didn't know in 2025. Reporting from September 2026 describes corporate legal departments, including large banking clients, asking outside counsel to show how AI efficiencies appear on their bills.

The question has moved from anecdote to measurable client expectations, and billing models are under pressure. One commentary notes that under a fixed fee, less labor becomes margin or a lower price, while under an unchanged hourly model the same reduction means less billable work. Attorneys should watch for clients demanding AI-adjusted pricing or outcome-based fee proposals, and should review how their firms document AI-driven efficiencies on invoices. The survey suggests clients are now pressing firms on price rather than simply adopting AI themselves, which makes billing transparency a near-term competitive issue.
