Why it matters

Major AI developers are short on computing capacity, and executives are now personally deciding how it gets allocated, according to a Wall Street Journal report. Rivals are forming alliances to secure supply. The clearest case is Anthropic, which agreed to buy compute through xAI's Colossus clusters through May 2029 at roughly $1.25 billion a month, according to a SpaceX IPO filing. xAI is now part of SpaceX and competes directly with Anthropic. OpenAI also finalized a deal to use Google Cloud for additional capacity despite its rivalry with Google's Gemini models. Nvidia is reportedly in talks to acquire Reflection AI, possibly through an acqui-hire.

The filing says SpaceX "may enter into additional compute capacity agreements with third parties in the future," but it does not commit to any. Anthropic's IPO is expected next month. The Information reports the company is pressing partners to bring forward about $530 billion in leased data center commitments. The Nvidia–Reflection talks are reported, not announced. Google's CFO has acknowledged that selling capacity to others could reduce Google's own supply. The Anthropic–xAI arrangement was first reported in May, when it was framed as access to more than 220,000 Nvidia GPUs.

For attorneys, the near-term items are disclosure and contract terms. Watch Anthropic's IPO documents for how it describes compute obligations and data center liabilities. Review any capacity agreement for change-of-control provisions, counterparty concentration, and what happens if a supplier is also a competitor. Acqui-hire structures like the reported Nvidia–Reflection talks also deserve a close look for deal-review and employee-retention questions. Analysts now treat compute as "becoming its own strategic asset class," so expect more of these contracts to reach the legal desk.
