Key Traps — Where Counsel Gets Caught
- 1. Dual conferral obligation: conferral before asserting objections does NOT satisfy the separate conferral requirement before requesting a hearing. Both are required. Asserting objections and then immediately requesting a hearing without a second conferral is procedurally deficient.
- 2. If you believe a request is vague, overbroad, or unduly burdensome, you must confer with opposing counsel to narrow scope BEFORE asserting those objections -- and you must still respond as to matters where the scope or burden is not contested.
- 3. Boilerplate objections (vague, overbroad, unduly burdensome without explanation) will be stricken.
- 4. Privilege log: detailed requirements apply; failure to timely produce a privilege log may be deemed a waiver of the privilege.
- 5. The court may rule on the papers without holding a hearing -- if it does, the scheduled hearing is automatically canceled.
