Why it matters

The U.S. Court of Appeals for the Federal Circuit on Thursday overturned a $59 million trade-secret damages award that Insulet Corporation had won against Korean insulin-pump manufacturer EOFlow Co., Ltd. The verdict stemmed from a jury finding that EOFlow misappropriated Insulet's confidential technology used in its Omnipod patch-pump system. The appeals court's decision eliminates what remained of a substantially larger award after earlier judicial reduction.

A federal jury in Massachusetts had initially returned a $452 million verdict in December 2024, comprising $170 million in compensatory damages and $282 million in exemplary damages. A trial judge subsequently reduced that award to $59.4 million, citing double-recovery concerns arising from a permanent injunction already issued against EOFlow. The Federal Circuit's reversal of even this reduced amount represents a complete reversal of the damages phase of the case, though the status of the underlying injunction remains unclear.

Insulet and its counsel should assess whether the appellate decision affects the injunction's enforceability or scope, and whether further appeal to the Federal Circuit or Supreme Court is viable. The ruling carries significance for medtech companies pursuing trade-secret claims, potentially narrowing the circumstances under which courts will award monetary damages alongside injunctive relief in similar disputes.
