Division Note

All West Palm Beach, Fort Lauderdale, and Miami matters assigned to Judge Rosenberg are heard in West Palm Beach at 701 Clematis Street, Courtroom 2.

Proposed Orders

Proposed orders are submitted in Microsoft Word format to Rosenberg@flsd.uscourts.gov. No CM/ECF attachment is required (in contrast with Judge Bloom).

Motions — Caption and First-Paragraph Rules

Every motion must include the word "Opposed" or "Unopposed" in the caption, placed under the case number.

The first paragraph of the motion must briefly summarize the parties' attempts to resolve the issue, setting forth the areas of agreement and the areas of disagreement.

These requirements apply to criminal motions as well — the procedures expressly state so.

Hearings

The court may schedule hearings sua sponte. Hearings run Monday through Friday beginning at 8:30 a.m. in 15-minute slots unless more time is needed.

Calendar Call

Calendar call is typically held on the Wednesday before the four-week trial period. Counsel may appear by telephone (instructions are in the trial-setting order). The four-week trial period is unusual among FL-SD district judges, who typically use a two-week trial period.

Status Conferences

Status conferences are typically held four to six weeks before trial. Counsel should be prepared to provide: anticipated trial length, witness count, and assessment of whether a settlement conference would be productive.

Compliance Traps

  • A motion missing "Opposed" or "Unopposed" in the caption is a specific deficiency Judge Rosenberg calls out.
  • A motion missing the conferral summary in the first paragraph is noncompliant.
  • The four-week trial period (vs. two-week for most FL-SD judges) affects scheduling math — read the trial order carefully on assignment.
